Terms and Conditions for use of this website
Date of Issue: 1 January 2006.
Please read the following terms and conditions carefully before continuing to use this Site.
"myMAPof… Ltd " is a subsidiary company of Rotography Ltd (company reg no. 4034072, United Kingdom) and operates this website ('the Site'). Rotography Ltd has its registered office address at Bowers Mill, Barkisland, Halifax.UK HX4 0AD. The myMAPof…site is provided free of charge for your convenience. In consideration for this we require that you agree to the following terms ('the Terms') for use of the Site. By accessing the Site you are agreeing to the terms that appear below, together with any specifi c terms set out on individual pages within the Site. If you have any questions, please email david@rotography.com These Terms (including any amendments made by us) will continue in force until such time as they are terminated. For details of how to terminate, please see below. This Site is designed for UK users and is not addressed to potential users outside the UK. Users should be aware that there is no representation or warranty that this Site complies with the regulatory regime other than that of the United Kingdom.
The price of the services offered
The prices on this website only apply to reservations made and paid for in advance. In all cases prices include VAT at 17.5%, except in Jersey, Guernsey and Eire where local taxes are included. Where a hotel features more than one offer at any one time, it may not always be possible to combine them - normally the most advantageous offer will be allowed. The prices advertised on the website are subject to availability. Please note that the rates and terms stated may not apply at some hotels over Bank Holiday weekends, the Christmas/New Year period, Valentine's weekend and Easter. We reserve the right to make changes to and correct errors in advertised prices at any time before your break is confirmed. We will advise you of any error of which we are aware and of the then applicable price at the time of booking. Once the price of your chosen product has been confirmed at the time of booking, we will not increase its price unless it is a booking for accommodation only, in which case we may increase its price by the amount of any increase in the rate of VAT.
Please note, changes and errors occasionally occur. You must check the price of your chosen break at the time of booking.
Making a booking
Subject to availability, we will confirm your booking by issuing a confirmation invoice.
This invoice should be checked carefully by you as soon as you receive it.
Contact us immediately if any information which appears on the confirmation or any other document appears to be incorrect or incomplete as it may not be possible to make changes later. All bookings for accommodation which do not require tickets will be accepted up to the day of departure. Bookings for air, rail, theatre and other breaks which require ticket despatch may not be accepted within 7 days of travel.
Payment
In order to confirm your chosen accommodation, payment must be made in accordance with the relevant providers terms . If you wish to purchase the insurance policy we offer, all applicable premiums must also be paid at the time of booking. Payment may be made by Mastercard, Visa, Diners Club, American Express, Maestro or Switch Card.
Insurance
Adequate travel insurance is essential. Please ensure that you are fully covered, if you feel that you are not adequately covered and do require any additional cover please do contact us.
Data Protection
For the purposes of the Data Protection Act 1998, we myMAPof…Ltd are a data controller. In order to process your booking, we need to collect certain personal details from you. These details will include, where applicable, the names and contact details of party members, credit/ debit card or other payment details and special requirements such as those relating to any disability or medical condition which may affect the chosen holiday arrangements and any dietary restrictions which may disclose your religious beliefs. If we need any other personal details, we will tell you before we obtain them from you.
Excursions, activities and information
The Site may refer to activities which are available in the area you are visiting. Where these activities are not part of a package we have no involvement in any such activities which are neither run neither supervised nor controlled in any way by us. They are provided by local operators who are entirely independent of us. They do not form any part of your contract with us even where we suggest particular operators/centres and/or assist you in booking such activities in any way. Accordingly, we cannot accept any liability in relation to such activities and the acceptance of liability of our booking conditions will not apply to them. We cannot guarantee accuracy at any time of information given in relation to such activities or about the area you are visiting generally (except where this concerns the services which will form part of your contract) or that any particular excursion or activity which does not form part of our contract will take place as these services are not under our control. If you feel that any of the activities mentioned which are not part of our contract are vital to the enjoyment of your holiday, write to us immediately and we will tell you the latest known situation. If we become aware of any material alterations to resort/area information and/or such outside activities which can reasonably be expected to affect your decision to book a holiday with us, we will pass on this information at the time of booking.
Accuracy of prices
Please note, the information and prices shown on this Site may have changed by the time you come to book. Whilst every effort is made to ensure the accuracy of the Site and prices, regrettably errors do occasionally occur. All photography used on this Site can only be taken as a guide. All maps included in this Site are for guidance only and are not to scale
Accommodation
In the absence of an international hotel grading scheme and to help you choose between hotels we have allocated each hotels star rating as identified by that countries authorised tourism such body. These do not necessarily conform to those awarded by the motoring organisations or by other national or international bodies.
HOTEL CLOSURES: Some hotels featured on this Site, particularly in remote areas, may close for periods during the winter months. If notification of closure is received after a reservation is made an alternative hotel/destination will be offered or cancellation will be accepted without charge.
EXTRAS/INCIDENTALS: Extra charges that may be incurred during your stay such as drinks and telephone calls must be paid to the hotel on departure and do not form part of this contract.
HOTEL PARKING: All offers of parking are subject to availability.
Termination
If either myMAPof…Ltd or you wish to terminate the agreement between us this can be done by sending an e-mail by us to your e-mail address and by you to reservations@myMAPof.com or by post by us by your usual address and by you to our registered office as given at the top of the page. Notices will be deemed to have been served one hour after transmission by email and 3 working days after despatch by post. You are responsible for notifying myMAPof…Ltd if any change to your e-mail address and where provided to us, your postal address. Any breach of these Terms shall entitle myMAPof…Ltd immediately to terminate the service to you without notice. Intellectual property
Unless otherwise stated, any intellectual property rights arising in respect of this Site's design, text, graphics, its selection and arrangement, software and all other material (the 'Content') on or in this Site belong to Rotography Ltd and/or its licensors. Any use of such Intellectual property rights or software or any reproduction of the content is strictly prohibited except where expressly allowed under these Terms. Permission is hereby granted electronically to copy and store (but not on any server or other storage device connected to a network) and print individual pages of the content on paper (but not photocopy them) from this Site only for the purpose of making use of our services. You may also permit your computer to make an electronically stored, transient copy of the Content for the purpose of viewing it while connected to the Internet only. However you may only make one copy of the Content. Any other use of the Content, including reproduction for purposes other than that hereby authorised (Including the removal of copyright or trade mark notices), creation of an electronic or manual database by systematically downloading and storing the Content. Distribution (whether electronically or not) or republication is prohibited. Any requests for permission to use the content in a manner otherwise than permitted by these Terms should be addressed to david@rotography.com For the avoidance of doubt, this permission does not transfer ownership to you or confer any other right on you in the whole or any part of the Content. The name and logo of myMAPof…Ltd are UK registered trademarks. You are not permitted to use or reproduce or allow anyone else to use or reproduce these trademarks for any reason. Copyright in any software that is made available to download from the Site ("Software") belongs to myMAPof…Ltd or its suppliers. Your use of the Software is governed by the terms of any licence agreement that may accompany or be included with the Software. In installing or using any Software you agree to be bound by the terms of such licence agreement. Rotography Ltd may from time to time give you the option to modify your browser to enable you to access certain requested services along with other applications. In the event, a dialogue box will be shown on your screen requiring your authorisation for the modification to proceed. By clicking the "Grant button" (or equivalent) on the dialogue box, you will allow Rotography Ltd to modify your browser to enable you to view the service on your screen at the same time as your work on other applications. The dialogue box may display a "High Risk" notice. The reason for this is that this modification makes it technically possible for the browser to be used by myMAPof…Ltd for other purposes. Rotography Ltd confirms to you that such modification will be used to view the requested service with other applications and (If you have clicked on "Remember this decision") to view in a similar way any other service you may specifically request from Rotography Ltd in the future.
Advertisements and Sponsorship
This Site may contain material, including advertising and sponsorship, which originates from third parties. These third parties are responsible for that material. It is the responsibility of such advertisers, sponsors and other third parties to ensure that such material complies with all relevant laws and regulations.
Hyper-links
We provide hyper-links to and from our Site to websites of third parties. Please note that we have no control over and are not responsible for the content of linked web sites and accordingly make no warranty or representation as to their contents. myMAPof… Ltd provides these links for your convenience only but does not necessarily endorse the material on those web sites nor are we in any way responsible for any transaction conducted between you and any such third parties to whose website we provide a link. You proceed to these websites at your own risk.
Promotions and offers
myMAPof…Ltd may make information regarding specific services, offers or promotions available on the Site. Any such service, offer or promotion is subject to the specific terms, conditions and restrictions listed on the Site in connection with such service, offer or promotion. Each service, offer or promotion is void where prohibited by law. Please refer to and read carefully the terms, conditions and restrictions included on the Site in connection with each service, offer or promotion. Please note that special offers are subject to availability.
Competitions and price draw
From time to time Rotography Ltd may competitions, free prize draws and promotions on the Site. These are subject to additional terms that will be made available at the time of such competitions, prize draws and/or promotions.
Illegal use
You may only use the Site for lawful purposes. You must not illegally transmit, distribute or store any material or violate any applicable regulation. This includes, without limitation, material, which is protected by copyright, trademark, trade secret or intellectual property right, which you use without permission. You may not circumvent or attempt to circumvent Rotography's security systems by 'cracking', 'hacking' or otherwise. In the interests of all our users, Rotography Ltd will co-operate with investigations by any law enforcement or relevant authorities of suspected criminal activity or violation of systems or network.
Privacy
We take the Issue of data protection very seriously. Our policy is set out in our Privacy Policy. So that we may comply with our obligations under Data Protection legislation, you are required to read and agree to the Privacy Policy before providing us with any Information about yourself. Failure to do so is a breach of these Terms. It is your responsibility to make sure that Information, which we hold, about you is up to date and accurate. Failure to do so will be a breach of these Terms.
Changes
myMAPof… Ltd reserves the right, at its discretion, to modify, add to or change the Site, these Terms, our Privacy Policy and any other policies at any time and any such modifications, additions or changes will be effective immediately on being posted to this Site. When such modifications, additions or changes are made to the Terms, the Privacy Policy or any other policies, this will be indicated by the Issue date at their start. It is your, responsibility to make sure that you are aware of any such modifications, additions or changes and you will be deemed to have accepted them if you access the Site after any modifications, additions or changes have been made. We will do our best to ensure that the Site is what we believe to be relevant, up to date and as interesting as possible and we accordingly reserve the right, at our discretion, to make changes to any part of this Site.
Changes and cancellation by us
Occasionally, we have to make changes to and correct errors on the Site and other details both before and after bookings have been confirmed and cancel confirmed bookings. Whilst we always endeavour to avoid changes and cancellations, we must reserve the right to do so. Most changes are minor. Occasionally, we have to make a "significant change". A significant change is a change made before departure which, taking account of the information you give us at the time of booking, we can reasonably expect to have a major effect on your break. If we have to make a significant change or cancel, we will tell you as soon as possible. If there is time to do so before departure, we will offer you the choice of the following options:
(a) (for significant changes) accepting the changed arrangements
(b) purchasing an alternative break from us, of a similar standard to that originally booked if available. We will offer you at least one alternative holiday of equivalent or higher standard for which you will not be asked to pay any more than the price of the original holiday. If this holiday is cheaper than the original one, we will refund the price difference. If you do not wish to accept the holiday we specifically offer you, you may choose any of our other then available holidays. You must pay the applicable price of any such holiday. This will mean your paying more if it is more expensive or receiving a refund if it is cheaper
(c) cancelling or accepting the cancellation in which case you will receive a full and quick refund of all monies you have paid to us. Please note, the above options are not available where any change made is a minor one.
NB The following paragraph does not apply to bookings of accommodation: If we have to make a significant change or cancel, we will pay you the compensation set out below subject to the following exceptions. Compensation will not be payable and no liability beyond offering the above mentioned choices can be accepted where (1) we are forced to make a change or cancel as a result of unusual and unforeseeable circumstances beyond our control, the consequences of which we could not have avoided even with all due care or (2) we have to cancel because the minimum number of bookings necessary for us to operate your holiday has not been reached - in this case we will notify at least 7 days prior to departure. No compensation will be payable and the above options will not be available if we cancel as a result of your failure to comply with any requirement of these booking conditions entitling us to cancel (such as paying on time) or if the change made is a minor one. A minor change is any change which, taking account of the information you have given us at the time of booking or which we can reasonably be expected to know as a tour operator, we could not reasonably expect to have a significant effect on your confirmed holiday.
Period before departure significant change or cancellation is notified to you - Compensation per person:
Over 56 days - no compensation
22 - 56 days - compensation per person, 2% of the cost of your accommodation
8 - 21 days - compensation per person, 5% of the cost of your accommodation
7 days or less - compensation per person, 10% of the cost of your accommodation
Your contract
A binding contract between us comes into existence when we despatch our confirmation invoice. This contract and all matters arising out of it are governed by English law. We both agree that any dispute, claim or other matter which arises out of or in connection with this contract or your holiday will be dealt with by the Courts of England and Wales only unless; in the case of Court proceedings you live in Scotland or Northern Ireland. In this case, proceedings may be brought in the Courts of your home country. If proceedings are brought in Scotland or Northern Ireland, you may choose to have your contract governed by the law of Scotland/Northern Ireland as applicable. Changes to these Booking Conditions will only be valid if agreed by us.
Behaviour
When you book with us, you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss must be paid direct at the time to the accommodation owner or manager or other supplier. If you fail to do so, you will be responsible for meeting any claims subsequently made against us (together with our own and the other party's full legal costs) as a result of your actions.
Special requests and medical problems
If you have any special request, you must advise us in writing at the time of booking. Although we will endeavour to pass any reasonable requests on to the relevant supplier, we regret we cannot guarantee any request will be met unless we have specifically confirmed this. We regret we cannot accept any conditional bookings, i.e. any booking which is specified to be conditional on the fulfilment of a particular request. All such bookings will be treated as "standard" bookings subject to the above provisions on special requests.
Disclaimer of warranty and liability
myMAPof…Ltd makes no express of implied warranty or representation; As to the accuracy, completeness, fitness for any particular purpose or currency of the information accessible via this Site and we request that wherever possible, you verify data which is available on the Site with an independent source; That the content is free from viruses or anything else that his contaminating or destructive properties including where such viruses or other programmes resulting loss of or corruption to your data or other property; or as to the operation, quality, functionality or accessibility of the Site. Whilst we will do our best to maintain the operation of the Site in accordance with this agreement, we will not be responsible for the computer equipment and telephone services, which you use to access the Site.
Please also note that the Site will on occasion be unavailable because of maintenance and repair works which we carry out on the Site. We will make reasonable efforts to ensure that downtime for maintenance and repair works is kept to a minimum. No other warranties, conditions, undertakings, representations, terms or other liabilities whether express or Implied, statutory or otherwise (if any) arising out of or in connection with use of (or inability to use) the Site or any material on the Site or any action or decision taken as a result of using the Site or any material on it are given. We will only be liable for any loss or damage which you suffer from your Use of the Site which results directly from our breach of this agreement or from our negligence and which loss or damage was foreseeable (i.e. it was obvious) to you and us at the time of entering into this agreement and where your use of this Site is for business purposes we will not be liable for any loss of business, profits, contracts, goodwill and/or any other economic loss. We will not be liable for the content of any third party websites or the actions or omissions of their proprietors nor for the contents of third party advertisements and sponsorship, which may appear on the Site.
The above exclusions and limitations shall not, however, operate so as to limit the liability of myMAPof…Ltd In respect of death or personal injury arising from negligence of myMAPof…Ltd or that of Its employees, agents or sub-contracts or in respect of any misinterpretation. Any liability of myMAPof…Ltd shall be limited in respect of any one incident or a series of two or more connected incidents to an amount equal to £1000.Any claim for loss or damage caused by us which you wish to make must be notified to us as soon as practicable after the 1oss or damage is discovered. In the event of any claim against us by a third party resulting from use of the Site by you, you will be responsible for all of our losses, damages and reasonable costs and expenses. In the event of a third party claim against us, you agree that you will: Give us full authority to conduct the matter, including as to defending or settling the matter; and Give us all reasonable assistance, which we require from you in relation to the matter. Except as expressly stated, nothing in these Terms will reduce your statutory rights relating to the manner in which we perform this agreement.
Cancellation by you
Should you or any member of your party need to cancel your chosen break once it has been confirmed, the party leader must immediately advise us by telephone and then confirm it in writing. Your notice of cancellation will only be effective when it is received in writing by us at our offices. As we incur costs from the time we confirm your booking, the following cancellation charges will be payable. Period before departure within which written notification of cancellation is received by us: Cancellation Charge
a) Breaks made up of accommodation only:
More than 7 days: £10 per booking. 7 days or less: 10% of total holiday cost or £10 per booking (Whichever is the greater). Day of arrival or non-arrival: 100% of total holiday cost. Occasionally, an accommodation provider may impose more severe cancellation terms, these terms will have unfortunately have to be passed on to you.
b) Breaks including a theatre ticket, event or activity:
You will be charged the fee detailed in a) above corresponding to the period before departure within which written notification of cancellation is received by us. In addition, you will be charged 100% of the supplement paid for the theatre, event, or activity element of your break. Insurance premiums and amendment charges are not refundable. All unused tickets (rail, theatre, event and activity) must be returned. Depending on the reason for cancellation, you may be able to reclaim these cancellation charges (less any applicable excess) under the terms of your insurance policy. Claims must be made directly to the insurance company concerned. Where any cancellation reduces the number of full paying party members below the number on which the price, number of free places and/or any concessions agreed for your booking were based, we will recalculate these items and re-invoice you accordingly. Please also note that if any member of your party is prevented from travelling, rather than making a cancellation that person may transfer their place to someone else.
Choice of law and jurisdiction
These Terms shall be governed by, and construed in accordance with, English law. We both agree, for the exclusive benefit of myMAPof…Ltd that the Courts of England shall have the exclusive jurisdiction to determine any disputes which may arise out of, under, or in connection with this Agreement, save that. It is agreed that this clause confers Jurisdiction for the benefit of myMAPof…Ltd only and myMAPof…Ltd shall reserve the right to bring proceedings against you in the Courts of any other country, which has jurisdiction.
General
You may not assign, sub-license or otherwise transfer any of your rights under these Terms. If any provision of these Terms is found to be invalid by any court having competent Jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. Failure by either party to exercise any right or remedy under these Terms does not constitute a waiver of that right or remedy. Headings in these Terms are for convenience only and will have no legal meaning or effect. These Terms cannot be varied except in writing by a director of myMAPof…Ltd. Nothing said by any employee or agent of myMAPof…Ltd will be capable of varying these Terms. Please read these Terms carefully before agreeing to them.
